Introduction:
This document outlines the Terms and Conditions of service for commissioning custom artwork from Linda Boucher. By using our website or commissioning artwork, you agree to these terms, which are designed to ensure a smooth, transparent, and fair process for both the client and the artist."
About the Service:
Throughout this document, 'The Artist' refers to Linda Boucher. 'The Client' refers to any individual who contacts The Artist with the intent to commission or purchase artwork."
The Artist creates original, hand-drawn artwork, for private use and display by The Client. Unless explicitly agreed upon, the artwork is a physical piece and is not a digital file or a printed reproduction.
The Artist, Linda Boucher, retains all copyrights and intellectual property rights to the artwork, including all sketches and digital files created during the commission process.
When you purchase a custom portrait, you are buying the original, physical artwork itself.
You do not have the right to reproduce, print, sell, or create merchandise from the artwork without express written permission from the artist.
The artist reserves the right to use images of the artwork for marketing and promotional purposes, including on social media, websites, or in a portfolio.
If you have a specific privacy request, you must communicate this to the artist before the commission begins.
The Commission Process:
How to order custom artwork, and what to expect when you so.
Initial Inquiry: The best way to start is to complete the contact form on my website, including your name, a quick message about what you’re interested in. Include your email address so I can reply. Please double check your email is correct.
Alternatively you can DM me on Instagram, or email me directly.
Sizes & Styles: I work on paper, up to a3 size. I offer two types of artwork: Sketches or full Colour Portraits. Let me know which you are interested in.
Reference Photos: When you are ready to send me a reference photo, I will send you a secure link to transfer your images to me. Emailing large photo files is not recommended. I prefer to work from clear, well lit close up photographs where the face and features are clearly visible.
Having received your photos I will offer you my ideas and initial thoughts. This is part of an ongoing collaborative conversation, where I try to accommodate your wishes, whilst offering my knowledge and professional advice.
Agreement & Deposit: When we have agreed upon details such as size, style and a time frame for completion of the final artwork, I will request a non-refundable deposit. This deposit is used to secure a spot in my Studio Diary, and is partly used to cover costs of materials. It also covers a small portion of the time I will use to create your artwork.
Progress & Revisions: After the deposit is recieved, I begin working on your commission. At this point I fully immerse myself in the artistic process. I will update you with a progress update. This is likely to be a verbal update, rather than a “work in progress” photograph. Artwork changes during its creation, and I have found incomplete work is not useful as a reference for clients.
Final Approval & Payment: When the artwork is complete, I will send you a low res photo for your approval. At this point your feedback is welcome, and necessary. When you are happy, I will request final payment, and we can discuss delivery details for your artwork
Delivery & Shipping:
Address Verification: I will ask for clarification and verification of your delivery address before completing the shipping labels and instructions to third parties.
Shipping Method: I use Royal Mail 24hr tracking service. If you are not happy for your artwork to be sent by them, please let me know your preferred shipping courier. Please note that RM24 is included in the price of your artwork order. If you request an alternative courier service, there may be additional costs, commensurate with the service requested.
Responsibility: I take every care to create high quality artwork, and I package the art in protective flat sleeves, a gift box, and a postal bag. The package will be too large for the average letter box. Once the parcel is in the courier’s system, I cannot be held responsible for damage or loss.
Damage or Non Delivery: Once the parcel has been shipped, The Artist cannot be held responsible for courier damage, delays, loss, or theft. However, The Artist will assist The Client in contacting the courier to make a claim. In the event of damage, The Client must take photos of both the packaging and the artwork. The Artist will work with The Client to find a suitable resolution.
Cancellations & Refunds:
Deposit: The deposit is non-refundable, with the exception of Artist’s Non Completion
Artist's Non-Completion: In the event I am unable to complete the artwork in the agreed time frame, for example due to illness, or other unexpected circumstances, I will refund the deposit at the earliest opportunity.
Communication & Conduct:
Response Time: I aim to respond to all inquiries within 48 hours. If you do not receive a response, please check for notices on my website or try an alternative contact method, such as Instagram or my direct email address.
Client Information: I care greatly about my client’s privacy and online safety. Please do not send any sensitive or private information to me via email or social media comments and messages. This includes, but is not limited to bank and bank card information, photographs with identifying information, or photos of people who have not agreed to my receiving their image.
Final Provisions:
Disclaimer: I endeavour to deliver exceptional customer service and beautiful, original, custom artwork.
I do not accept liability for events outside of my control, including but not limited to extreme weather, shipping delays, or third-party failures.
Governing Law: I am based in Brighton, UK, and this agreement is governed by the laws of England & Wales.
